The Office of Administrative Hearings (OAH) is accepting applications for on-call Administrative Law Judge positions throughout the state. On-call for these positions is defined as working typically 16 hours per week or more, depending on workload and being available to substitute for other Administrative Law Judges on short, unpredictable notice. Some evening and weekend work may be possible. OAH's mission is to independently resolve administrative disputes through accessible, fair, prompt process hearings for the public and for government agencies, and to issue sound quality and timely decisions. OAH conducts hearings for more than 30 state agencies, including the Employment Security Department and Department of Social and Health Services. Duties:
An Administrative Law Judge (ALJ) may conduct several types of hearings, including, but not limited to child support, public assistance, unemployment insurance compensation, professional licensing, and other governmental benefit or regulatory programs. Hearings vary in complexity. Some, like toll violation appeals, involve fast-paced, high volume work with minimal decision-writing. Others relate to agency regulatory activities and may involve hearings over several days, substantial motion practice, and complex legal issues. ALJs are expected to manage the variety in case type and complexity. ALJs provide high quality and timely administrative hearings and decisions pursuant to RCW Chapter 34.05 and other applicable laws consistent with the requirements of due process. ALJs provide courteous and fair treatment to all concerned. The ALJ works as called upon to support and carry out the agency mission, vision, values, and goals.
The ALJ is responsible for:
Conducting fair and impartial hearings for all parties;
Swearing in witnesses, taking testimony, and ruling on exhibits;
Being available and prepared to conduct hearings promptly at the scheduled time and to substitute for other ALJs as needed;
Determining the relevancy of testimony as it is occurring, ruling on admissibility of evidence and deal difficult persons who are upset or are having difficulty understanding the proceeding;
Making a clear and complete hearing record;
Analyzing legal issues and problems, applying legal principles and precedents with a commitment to making an unbiased and legally correct decision;
Reading exhibits, pleadings, and legal reference material;
Issue decisions within strict timelines required by OAH standards and the governing federal and state law or program;
Issuing written initial or final orders containing necessary findings of fact and conclusions of law disposing of all legal issues;
Notifying the supervising ALJ if unable to cover caseload or meet timelines;
Developing and maintaining current knowledge of administrative rules and other substantive law;
Transporting equipment and hearing records (including exhibits) to and from official work station. Hearing records and equipment may weigh up to 40 pounds;
Traveling throughout Washington State may be required.
Qualifications:
Required:
A Juris Doctorate degree and a minimum of five years of legal experience;
Active or Judicial member of the Washington State Bar Association or such a member of any state's bar association;
Demonstrated knowledge of administrative law and procedures;
ALJs must have the ability to manage stressful situations and emotional parties. Hearings are often litigated very aggressively and emotionally and require an administrative law judge who can control and guide the process effectively;
Able to interact with the public, support staff and other ALJs with judicial demeanor at all times;
Speak and write clearly and effectively.
