The Health Care Authority (HCA) is Washington’s l! argest health care purchaser, responsible for providing comprehensive health coverage to more than 1.5 million residents through the Public Employees Benefits Board program and as the single state agency for the Medicaid program. To meet its mission, HCA strives to be a prudent purchaser of health care and an accountable organization, providing health transformation leadership to the benefit of both the public and private sectors with a focus on moving the health delivery system away from volume toward higher value and better outcomes. Increasingly, HCA is involved in activities under the Affordable Care Act through Medicaid Expansion and subsidies available in the Health Benefit Exchange. The agency anticipates more than 300,000 new clients over the next two years. HCA is a key player in the effort to develop a streamlined, efficient process for gaining health coverage for high quality health care services.

POSITION OBJECTIVE:
The Board of Appeals (BOA) reviews hearing decisions issued by the Administrative Law Judges (ALJ) who preside over adjudicative proceedings related to HCA client benefits or provider overpayments. The BOA review judge then issue a final decision on behalf of HCA. BOA also conducts all nursing home cost reimbursement rate and audit appeals and provides technical legal information and training on hearings. Decisions rendered by BOA judges may be appealed to Superior Court.

Duties:
The Review Judge reviews and analyzes the records of HCA/DSHS adjudicative proceedings.

The Review Judge performs legal research using computer software and online resources, including the Revised Code of Washington and the Washington Administrative Code. The Review Judge reviews the evidence prese! nted by the parties, including all testimony and exhibits, evaluates the ALJ’s statement of facts and application of the law, and determines the correctness of the decision.
Where a Petition for Review has been filed contesting a hearing decision, the Review Judge reviews the record of the adjudicative proceeding conducted by the ALJ and renders the final agency decision.

The Review Judge issues a final decision which includes the fact of the case, a statement of the legal issues presented, an analysis of the evidence, findings of fact, and conclusions of law based on applicable federal and state laws, the Washington Administrative Code, and court decisions. The Review Judge uses computers and word processing software to produce final department decisions that are timely, legally sufficient, and clearly written.
The Review Judge advises the supervisor of recurring issues associated with the administrative hearing and review processes, outdated or unclear ! regulations, and training of department staff.

Informs supervi! sor and colleagues of any unusual issues discovered while reviewing cases.
The Review Judge provides training, participates in staff meetings and committees, and provides input and decision-making on a variety of HCA legal and appeal-related issues.

The Review Judge provides orientation and training to new review Judges; participates in staff meetings; provides consultative and technical services to HCA programs in matters relating to administrative hearings; participates in agency committees and initiatives regarding department policy and the administrative hearings process; analyzes and interprets federal and state laws, regulations, and policies; assists in the design, creation, and implementation of objective and pertinent methods for the efficient, effective, and economical review of cases; represents BOA in meetings and conferences; performs bill analysis regarding the impacts of proposed legislation; operates computer software programs including MS Word;! learns new or additional software applications as needed; and inputs necessary data into the computer. Maintains the confidentiality of agency and HCA-client information in accordance with agency policy, contracts and laws applicable to information confidentiality (e.g. HIPAA).
The Review Judge performs other duties as assigned.

Qualifications:
Required Qualifications :
Four (4) years of experience as a hearings examiner in a governmental agency OR
Four (4) years as a member of an administrative tribunal empowered to issue findings of fact and conclusions of law OR
Four (4) years of trial practice in private or public employment.
Note : One(1) year of any of the above experience must be in the field of law related to cases heard by HCA.

Preferred/Desired Qualifications :
Knowledge of: administrative, procedural, substantive, and common law; rules of evidence; specific bodies o law applicable t! o the hearings, including Federal and State statutes, court decisions, ! and regulations; departmental policies relevant to the contested case and rule-making hearing processes; public disclosure law; and organization of the department.
Ability to review the hearing record for irregularity in the proceedings; conduct legal research and provide legal advice to peers, superiors, and disclosure coordinators; review the hearing record for errors in fact finding, instructions to parties, ruling on the admissibility of evidence, the application or interpretation of the law, and any other elements which could result in improper resolution of issues; draft findings of fact, conclusions of law, and orders which are clear and concise; instruct others in disclosure law and on administrative law and hearing process; preside at rule-making hearings.
Active or judicial membership in the Washington State Bar Association.
Juris Doctor degree from an ABA-accredited law school

This position is currently in a bargaining unit represented by the Washington Federation of State Employees (WFSE).
